These entities act as joint data controllers for the personal data described in this policy.

2. What Data We Collect

We collect limited personal data necessary to operate our services and communicate with our customers and prospects. This includes: 

  • Business contact details: Name, email address, job title, and phone number. 
  • Account access data: Login credentials (email address and securely hashed passwords). 
  • Correspondence data: Email conversations and customer support interactions. 
  • Website usage data: IP address, browser type, location (approximate), and page activity, via Google Analytics. 

We do not collect sensitive personal data or consumer personal data through our product.

4. Who We Share Data With

We share personal data only with trusted processors who support our operations and are bound by GDPR-compliant data processing agreements: 

  • Cloud Hosting Provider: Microsoft Azure (EU) 
  • CRM & Marketing: HubSpot (USA) 
  • Email & Productivity Suite: Microsoft 365 (EU and/or USA) 
  • Web Analytics: Google Analytics (data may be processed in the USA) 

We do not sell personal data or allow third parties to use it for their own marketing purposes. 

 5. International Transfers

Some personal data is transferred outside the European Economic Area (EEA) to service providers such as HubSpot and Google. When this happens, we use safeguards including: 

  • EU Standard Contractual Clauses (SCCs) 
  • Additional security and contractual protections 

These measures ensure that your data remains protected to EU standards.

6. Data Retention

We retain personal data only as long as necessary: 

  • Account data: Stored for the duration of the customer relationship and deleted within 6 months of contract termination. 
  • Marketing contact data: Reviewed and deleted after 24 months of inactivity. 
  • Support correspondence: Retained for up to 3 years for service and legal purposes. 

In some cases, data may be retained longer if required by law or for dispute resolution.

7. Your Data Rights

Under the GDPR, you have the right to: 

  • Access your personal data 
  • Correct inaccurate data 
  • Request deletion 
  • Object to or restrict processing 
  • Request data portability (where applicable)

8. Changes to This Policy

We may update this Privacy Policy to reflect changes in legal requirements or our business operations. Material changes will be communicated via our website or email.

Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of our SaaS platform and related services. By accessing or using our services, you agree to be bound by these Terms.

1. DEFINITIONS

  • “Company” refers to Carbon Harvesters Limited, registered in Ireland. 
  • “Service” means our software-as-a-service (SaaS) solution and related features. 
  • “Customer” means the entity agreeing to these Terms. 
  • “User” refers to individuals authorized by the Customer to use the Service. 
  • “Agreement” refers to these Terms, our Privacy Policy, and any Service Order signed between the parties.

2. ACCEPTANCE OF TERMS

By registering, accessing, or using the Service, you confirm that:

  1. You have the legal authority to enter into this Agreement.
  2. Your use complies with applicable laws and regulations.
  3. You have read and understood our Privacy Policy.

3. SERVICES PROVIDED

  • The Company provides a cloud-based SaaS platform for reporting of environmental impacts and mitigation of these.  
  • The Service is provided on a subscription basis (monthly/yearly). 
  • We reserve the right to modify, update, or discontinue any feature with prior notice.

4. ACCOUNT REGISTRATION & RESPONSIBILITIES

  • You must provide accurate and complete information when creating an account. 
  • You are responsible for maintaining the confidentiality of login credentials. 
  • Unauthorized use of your account should be reported immediately. 
  • You agree not to share your login details with unauthorized parties.

5. SUBSCRIPTION & PAYMENT TERMS

  • Fees are payable in advance as per the service order.  
  • Failure to pay may result in suspension or termination of access. 
  • All payments are non-refundable, except as required by law. 
  • We reserve the right to adjust pricing with 30 days’ notice. 

6. DATA PROTECTION & GDPR COMPLIANCE

  • We comply with GDPR (Regulation (EU) 2016/679) regarding data processing. 
  • We act as a Data Processor when handling customer data. 
  • Our Privacy Policy outlines how we collect, use, and store data. 
  • Customers must ensure they have the legal basis to provide data to us.

7. ACCEPTABLE USE POLICY

You agree NOT to: 

  • Use the Service for illegal or unauthorized purposes. 
  • Upload malicious code, viruses, or automated scripts. 
  • Reverse-engineer, resell, or sub-license our platform. 
  • Violate any data privacy laws or third-party rights.

8. INTELLECTUAL PROPERTY RIGHTS

  • We retain all rights to the software, trademarks, and platform. 
  • You may use our Service only as granted under these Terms. 
  • Customers retain ownership of their uploaded content and data. 

9. SERVICE AVAILABILITY & SUPPORT

  • We strive for 99.9% uptime, but do not guarantee uninterrupted access. 
  • Maintenance or updates may cause temporary downtime (we’ll notify you). 
  • Our support team is available during business hours at info@odostech.com. 

10. TERMINATION

We may terminate or suspend your access if: 

  • You violate these Terms. 
  • Subscription fees are not paid. 
  • Required by law or regulatory obligations. 
    You may terminate your subscription at any time via info@odostech.com

11. LIMITATION OF LIABILITY

  • We are not liable for indirect, special, or consequential damages. 
  • Our total liability under this Agreement shall not exceed the amount paid in the last 12 months. 

12. FORCE MAJEURE

We are not responsible for delays or failures caused by events beyond our control (e.g., natural disasters, cyberattacks, government restrictions). 

13. GOVERNING LAW & DISPUTE RESOLUTION

  • These Terms are governed by the laws of Ireland. 
  • Any disputes will be resolved through negotiation, mediation, or arbitration. 

14. CHANGES TO TERMS

We may update these Terms from time to time. Changes become effective 30 days after notification. Continued use of our Service means you accept the changes.

ODOS Tech uses cookies to improve your experience, understand how our website is used, and deliver relevant content. This policy explains the types of cookies we use on odostech.com, their purpose, and how you can manage your preferences.

1. What Are Cookies?

Cookies are small text files stored on your device when you visit a website. They help websites remember your actions and preferences and can collect technical or usage information to improve performance, security, and personalization. 

 2. Who Controls the Cookies?

Cookies on odostech.com are set by ODOS Tech (Carbon Harvesters Limited – Ireland / Carbon Harvesters Global SL – Spain) and by trusted third-party providers (e.g., HubSpot, Google, Cloudflare).

3. Categories of Cookies We Use

We group cookies into four categories, based on the a Cookiebot scan on 17th of April 2025.

A. Necessary Cookies (13 total) 

These cookies are essential for the website to function properly (e.g., page navigation, form security). 

Examples: 

  • __cf_bm – from HubSpot and Cloudflare: used to distinguish humans from bots 
  • CookieConsent – stores your cookie consent preferences 
  • wpEmojiSettingsSupports – WordPress presentation and UI settings 

These cannot be disabled. 

B. Statistics Cookies (4 total) 

Used to understand how visitors interact with the site (anonymously). We use Google Analytics for this purpose. 

Examples: 

  • _ga, _ga_# – track visitor behavior across sessions 
  • __hssc, __hstc, hubspotutk – set by HubSpot for tracking user behavior

C. Marketing Cookies (8 total) 

Used to show relevant ads and measure campaign performance across websites. 

Examples: 

  • _gcl_au, pagead/1p-user-list/# – Google Ads and remarketing 
  • __ptq.gif, __hmpl – HubSpot marketing interactions 
  • _lf_a, _lf_a_expiry – Leadfeeder cookies for account-based marketing

D. Unclassified Cookies (5 total) 

These are new or not yet categorized. They include: 

  • _fuid and try_get_old_cookie (Factors.ai and ODOS custom scripts)

4. Managing Cookie Preferences

You can: 

  • Accept or reject non-essential cookies via our cookie banner. 
  • Withdraw consent at any time using the cookie privacy center in the website footer. 
  • Delete existing cookies in your browser settings.

5. Data Transfers

Some cookies (e.g., from Google and HubSpot) may transfer data outside the EEA. In such cases, we ensure appropriate safeguards (e.g., Standard Contractual Clauses) are in place.
